Please read the following Terms of Service carefully, as they outline the terms governing your engagement with Motif Studio.

By engaging Motif Studio’s services (e.g. booking a shoot, accepting a quote, or submitting a verbal/written request), you agree to be bound by these Terms of Service.

In this agreement:

• Services refer to any work agreed upon and carried out by Motif Studio for the Client.

• Budget means the Client-allocated amount to be spent on paid social media promotions.

• Due Date is the agreed delivery date as specified in the quote or this agreement.

• Additional Services are any tasks outside the original scope of Services.

• Credit Line includes clear attribution to Motif Studio, such as “Video by Motif Studio” or tagging our official accounts.

• Edit means any modifications made to the final delivered content by Motif Studio.

• Documentation includes any strategic plans, briefs, analytical reports, or written agreements.

• Pricing Structures refer to quotes, packages, or invoices issued to the Client.

• Strategy includes conceptual or marketing frameworks discussed and created by Motif Studio.

• Product includes all final deliverables, such as photographs, videos or graphic designs.

• Product delivery timelines will follow the schedule noted in the Client’s quote or invoice.

• Motif Studio allows up to 10 business days beyond the Due Date for unforeseen delays.

• Delivery is deemed complete once content is uploaded to a shared Google Drive or similar platform.

• All bookings must be submitted via our official website or by email to info@motifstudio.com.au.

• We will do our best to accommodate your preferred date/time, but availability cannot be guaranteed.

• Additional Services must be requested and agreed upon in writing. Any confirmed scope changes and associated fees will be binding.

• Clients remain liable for costs of approved changes, even if they later change their minds.

Cancellations or location/schedule changes must be submitted in writing at least 3 days prior to the production date.

• Cancellations within 48 hours incur a 10% cancellation fee of the service value.

• Cancellations within 24 hours incur a 25% cancellation fee of the service value.

• Cancellations on-site or without notice will be charged the full shoot fee.

Phone notifications must be followed up with written confirmation within 24 hours.

• Payments are due as per the relevant invoice or quote.

• Payments must be made via accepted payment methods outlined on the invoice.

• A 5% weekly compounding late fee will apply if payments are overdue beyond two weeks.

• Approved Additional Services will be invoiced separately.

• Clients must ensure the shoot location is ready (cleaned, decluttered, and staged). Motif Studio is not responsible for moving personal items.

• Clients are encouraged to attend shoots to ensure satisfaction.

• Failure to provide access, approvals, or timely communication may result in delays for which Motif Studio is not liable.

• Interference from other individuals may impact the final Product. We are not responsible for such disruptions.

• In unsafe, illegal, or objectionable environments, we may halt the shoot without refund.

• Revisions must be requested within 10 business days of delivery. After that, changes will be considered Additional Services.

• All products remain the intellectual property of Motif Studio. This clause survives termination of the agreement.

• Clients are granted non-exclusive usage rights for personal or business use (e.g. social media, websites).

• Content must not be resold, relicensed, or transferred without Motif Studio’s written permission.

• Motif Studio reserves the right to use delivered content for portfolio or promotional purposes.

• Final videos are delivered in MP4 format (1080p or 4K). Photos are delivered in high-resolution JPG. Other formats are available upon request.

• Raw files (e.g. unedited photos, video footage, design files) are not included but can be provided for an additional fee. All raw content remains the property of Motif Studio unless otherwise agreed.

• Clients may not edit or modify Motif Studio Products without written approval for each instance.

• Documentation and Pricing Structures are confidential and must not be shared externally without prior consent.

• In the event of corrupted or lost files, Motif Studio will make best efforts to reschedule and recapture content at no extra charge.

• Once final content is approved, we are not obligated to retain or back up any files.

• All sensitive information shared by the Client will be kept strictly confidential.

• Our Strategies will not be disclosed externally without Client approval.

• All quotes remain valid for 30 days from their issue date. After this, pricing is subject to change.

• Motif Studio is not liable for loss or damages resulting from our actions, including negligence.

• If services are interrupted by natural disasters, emergencies, or illness, all payments will be refunded, and this agreement will terminate immediately.

• In legal disputes, the prevailing party is entitled to recover legal fees and related costs.

• Motif Studio reserves the right to terminate services at any time.

• Either party may mutually agree to terminate services in writing, outlining payment and deliverables.

• Unilateral termination by the Client requires 90 days’ written notice and repayment of any discounts or complimentary services received.

• Motif Studio may enforce the payment of remaining fees upon termination.

• Disputes should first be addressed via mediation before legal proceedings.

• These Terms are governed by Queensland law.

• This agreement stands in place of a formal written contract unless otherwise specified.

• By engaging Motif Studio, you confirm all necessary details (e.g. location access, preferences, drone permits) have been provided.

• Engaging our services constitutes acknowledgment and acceptance of these Terms.
